Terms of Service 

FIREPROOF Method Course

Effective Date: Date of purchase

1. Definitions

1.1 Program: The FIREPROOF Method course, a wellness program designed for firefighters and first responders.

1.2 Program Materials: All content provided as part of the Program, including but not limited to videos, worksheets, PDFs, and other supporting documents.

1.3 Customer: Any individual, firefighter, or first responder who registers for and accesses the Program.

1.4 Commencement Date: The date the Customer completes the initial payment.

1.5 Services: Access to the Program, including pre-recorded videos, worksheets, and optional telemedicine services, if purchased separately.

2. Commencement and Duration

2.1 Program Access: Access to the Program begins on the Commencement Date and continues for the lifetime of the program.

2.2 Subscription Period: Customers enrolled in membership plans will maintain access to subscription bonus materials for the duration of their active subscription.

2.3 Access Expiration: Access to the Program materials expires after the defined period, regardless of whether all materials were accessed or completed by the Customer. 

3. Service Fees

3.1 Payment Structure: The Program is available through:

 

  • A one-time payment.
  • 4 monthly payment option for telemedicine package only
  • 12 monthly payment option for VIP package only

 

3.2 Refund Policy: Refunds may be requested within 30 days of purchase and will be calculated based on progress made in the course. Contact [email protected] to initiate a refund request. No refunds will be issued for any telemedicine services already provided. 

3.3 Late Payments: Customers with overdue payments will have their access to the Program suspended until the account is brought up to date.

4. License

4.1 Grant of License: Customers are granted a non-exclusive, non-transferable, limited license to access and use Program Materials for personal, non-commercial purposes only.

4.2 Prohibited Actions: Customers may not:

 

  • Copy, share, or distribute Program Materials.
  • Record or reproduce materials for sale or public display.
  • Modify or create derivative works from Program content.

 

4.3 Ownership: All rights, including copyrights and trademarks, in the Program and Program Materials remain the exclusive property of FIREPROOF Wellness.

5. Access to Services

5.1 Authorized Access: Only the registered Customer is authorized to access the Program. Sharing login credentials or materials is strictly prohibited and subject to access termination.

5.2 Service Interruptions: FIREPROOF Wellness strives to ensure continuous access but is not liable for interruptions caused by factors beyond its control, including technical issues or maintenance.

5.3 Monitoring: FIREPROOF Wellness reserves the right to monitor access and usage to prevent unauthorized use.

6. Termination and Cancellation

6.1 Termination by FIREPROOF Wellness: Access may be revoked immediately for:

 

  • Non-payment.
  • Violation of these Terms of Service.
  • Sharing or reproducing Program Materials.

 

6.2 Cancellation by Customer: Customers may cancel their participation by contacting FIREPROOF Wellness. Refunds for cancellations will be handled per the refund policy outlined in Section 3.2.

7. Limitation of Liability

7.1 Educational Purpose: The Program is for informational purposes only and is not a substitute for professional medical advice.

7.2 No Guarantees: FIREPROOF Wellness does not guarantee specific outcomes or results. Success in the program is highly dependent on the effort and adherence of each participant. 

7.3 Liability Waiver: FIREPROOF Wellness is not liable for any injuries, losses, or damages resulting from participation in the Program or use of its materials.

8. Testimonials

By enrolling, Customers consent to the use of their testimonials, feedback, or comments by FIREPROOF Wellness for marketing purposes. Testimonials may be edited for clarity but will not alter the original context or intent.

9. Reproduction and Competition

9.1 Restrictions on Reproduction: Customers may not reproduce, share, or sell Program content.

9.2 Non-Competition Clause: Customers agree not to create, sell, or distribute similar firefighter wellness programs for a period of 18 months after the Commencement Date.

10. Miscellaneous

10.1 Entire Agreement: This document constitutes the entire agreement between the Customer and FIREPROOF Wellness.

10.2 Assignment: This Agreement may not be assigned by the Customer. FIREPROOF Wellness reserves the right to assign this Agreement.

10.3 Amendments: FIREPROOF Wellness reserves the right to update these Terms of Service at any time. Continued use of the Program indicates acceptance of the updated terms.

10.4 Governing Law: These Terms of Service are governed by the laws of the State of Tennessee. Disputes shall be resolved in Tennessee courts.

11. Disclaimers

11.1 Program Disclaimer: The Program is for educational purposes only and is not intended as a substitute for medical, legal, or financial advice.

11.2 Technology Disclaimer: FIREPROOF Wellness is not liable for technical issues, including outages or incompatibility with the Customer’s devices.

11.3 No Guarantees: FIREPROOF Wellness makes no guarantees regarding the accuracy or completeness of Program content.

Telemedicine Terms and Acknowledgment

1. Availability of Telemedicine Services

 

  • Telemedicine services are available to clients residing in the following states: California (CA), Arizona (AZ), Virginia (VA), North Carolina (NC), Florida (FL), Tennessee (TN), Missouri (MO), Texas (TX), Pennsylvania (PA), and Michigan (MI).

 

2. Independent Medical Providers

 

  • Telemedicine services are provided by independent medical providers trained in the FIREPROOF first-responder-centered care model and the FIREPROOF Method.
  • FIREPROOF Wellness is not a medical practice but operates as a management services organization (MSO) for these independent medical providers.

 

3. Self-Pay Medical Services

 

  • All telemedicine services are self-pay.
  • Providers do not contract with insurance companies, submit claims, or communicate with insurance companies on behalf of clients.

 

4. Insurance Reimbursement

 

  • Clients with PPO insurance may be eligible for partial reimbursement for telemedicine costs.
  • To request reimbursement, clients may:
  • Request an itemized receipt known as a "superbill" from the medical provider.
  • Submit the superbill directly to their insurance claims department.
  • Clients are responsible for:
  • Understanding their insurance plan type (HMO or PPO).
  • Familiarizing themselves with the superbill submission process.
  • Determining what percentage of medical costs may be reimbursed.
  • Submitting all receipts to their insurance company.

 

5. Laboratory Services

5.1 Insurance-Billed Labs

 

  • Labs ordered by telemedicine providers are at additional cost and may be billed directly to PPO insurance plans.
  • Clients are responsible for understanding their lab coverage through their insurance provider.

 

5.2 Self-Pay Labs

 

  • For clients with HMO insurance or without insurance, lab services can be ordered at a pre-negotiated discounted rate through Quest Diagnostics Laboratory.
  • All self-pay labs must be pre-paid before services are rendered.

 

5.3 Functional Labs

 

  • Functional lab panels such as PFAS, NutrEval, and Galleri cannot be billed to any insurance company and must be paid for out-of-pocket by the client.

 

6. Prescription Management

 

  • Prescription Management is available for telemedicine patients for select medications pertaining to first responder health and wellness including Enclomiphene, which is discussed within the program for its use in testosterone optimization.
  • NO CONTROLLED SUBSTANCE PRESCRIBING is offered through this telemedicine service. If your provider determines that you are best supported by testosterone replacement, you will be referred to a clinic of your choice for this prescription.

 

8. Client Acknowledgment

By purchasing a telemedicine package, I acknowledge that:

 

  • I currently have and maintain a relationship with a primary care provider. Telemedicine services are not intended to replace the relationship with a local primary care provider, but to provide increased access to this specialized area of care. 
  • I understand telemedicine services are provided by independent medical providers and not FIREPROOF Wellness.
  • I am responsible for all payments and any efforts to seek reimbursement from my insurance provider.
  • I am responsible for understanding my insurance coverage, including processes for submitting superbills and potential reimbursement for telemedicine services or laboratory costs.
  • I agree to pre-pay for any self-pay laboratory services, where applicable.
  • I reside in one of the following states where telemedicine services are offered: California (CA), Arizona (AZ), Virginia (VA), North Carolina (NC), Florida (FL), Tennessee (TN), Missouri (MO), Texas (TX), Pennsylvania (PA), and Michigan (MI).
  • I have read and understood the terms outlined in this document.
